NOTICE OF ADOPTION OF SHORT-TERM RENTAL ORDINANCE On November11, 2025, the Trustees of the Village of North Bennington, Vermont, adopted the Short-Term Rental Ordinance pursuant to 24 V.S.A. ss1972. This notice is published pursuant to 24 V.S.A. 1972 to inform the public of these amendments and of the citizens' right to petition for a vote to disapprove these amendments. Village of North Bennington, Vermont Short-Term Rental Ordinance Summary The Trustees of the Village, with the assistance of the Planning Commission, have established goals for this legislation. With the rising trend towards regulating short-term rentals in other communities, the Trustees have weighed the potentially positive and negative impacts that short-term rentals provide. The Trustees have been sensitive to the need to balance a myriad of conditions that arise with short-term rentals and with this ordinance hope to create a framework that will allow the Village to support short-term rentals while protecting the charm and character of our Village. Opportunities that could result from permitting short-term rentals include allowing residents to generate additional personal income; providing residents with overflow housing for out-of-town guests; providing parents and/or potential new students at Bennington College an opportunity to spend the night in the Village; and providing residents with an opportunity to rent their property while away for vacations. Representative negative impacts that could be attributed to short-term rentals might include a reduction in affordable apartment rentals; increased number of non-resident property owners in the Village; and noise that might emanate from groups that might be using a short-term rental as an overnight party venue. In balancing these concerns, the following ordinance has been written to help guide the Village as it continues to evolve and develop. Legislative Purpose 1.1 To permit hosted short-term rentals in safe and sanitary conditions. 1.2 To permit but limit un-hosted short-term rentals in a manner that preserves the character of the Village, avoids nuisances, preserves long-term rental potential, and ensures safe and sanitary lodging. 2.0 Authority 2.1 Municipal power to regulate short-term rentals derives from 24 VSA Chapter 061, Subchapter 011, Section 2291(29) The full text of the Ordinance may be examined at the Village Depot office at 1 Depot St North Bennington by appointment (info@villagenorthbennington.org) and may be examined on the website, www.villagenorthbennington.org. It is also available in the Post Office, McCullough Library, Prospect Caf , Powers Market. CITIZENS' RIGHT TO PETITION FOR VOTE Title 24 V.S.A. 1973 grants citizens the right to petition for a vote at a special or annual Village Meeting to disapprove ordinance amendments adopted by the Trustees. To exercise this right, citizens must present to the Trustees or the Town Clerk a petition for a vote on the question of disapproving the amendments signed by not less than five percent (5%) of the Village's qualified voters. The petition must be presented within forty-four (44) days following the date of the adoption of the amendments. Unless a petition requesting a vote is filed pursuant to 24 V.S.A. 1973, the amended "Short Term Rental Ordinance" shall become effective sixty (60) days from the date of said adoption.
