ACT 250 NOTICE MINOR APPLICATION 8B0059-2 10 V.S.A. 6000 - 6111 Application 8B0059-2 from 1934Plymouth, Inc., 5403 VT Rt. 7A, Arlington, VT 05250, was received on December 6, 2024, and deemed complete on June 23, 2025. The Applicant seeks after-the-fact approval for the following site improvements: the construction of a beer garden/patio and use of a 20-foot by 40-foot tent for seasonal outdoor restaurant service and live music events; installation of additional lighting and signage; relocation and screening of the dumpsters; and installation of tiny homes and storage shed on the foundation of the previous mobile home and perimeter fence. The project also includes implementation of a wetland mitigation plan. The Project is located at 5403 VT Route 7A in Arlington, Vermont (SPAN: 015-005-10560). The application may be viewed on the Land Use Review Board's website (https://act250.vermont.gov/) by clicking "Act 250 Database" and entering the project number "8B0059-2." No hearing will be held, and a permit may be issued unless, on or before July 22, 2025, a party notifies the District 8 Commission in writing of an issue requiring a hearing, or the Commission sets the matter for a hearing on its own motion. Any person as defined in 10 V.S.A. 6085(c)(1) may request a hearing. Any hearing request must be in writing, must state the criteria or sub-criteria at issue, why a hearing is required, and what additional evidence will be presented at the hearing. Any hearing request by an adjoining property owner or other person eligible for party status under 10 V.S.A. 6085(c)(1)(E) must include a petition for party status under the Act 250 Rules. Notice of Public Hearings The Bennington County Regional Commission (BCRC) will hold a public hearing at 6:15 PM on Thursday, July 17, 2025 at 1072 Warm Brook Road, Arlington, VT 05250 to consider approval of the Manchester Town Plan and North Bennington Village Plan pursuant to 24 VSA Sections 4350. The BCRC will consider comments at the hearing regarding conformance with the statutory requirements for a municipal plan and will vote to approve the plans if found to meet those requirements. The BCRC will then convene a second public hearing to consider and vote on the question of whether the Manchester Town Plan meets the standards for a determination of energy compliance pursuant to 24 VSA Section 4352.
