Mobile Home Park Inc., is a Vermont corporation with a place of business in the Town of Bennington, Vermont. 2. Plaintiff is a "mobile home park owner," as defined by 10 V.S.A. 6201(7), of a mobile home park known as "White Birch Mobile Home Park" located on Barney Road within the Town of Bennington and County of Bennington, Vermont ("the Park"). 3. The name and last known mailing address of the lessee with White Birch Mobile Home Park is Wesley Bennet, Lot 21, Barney Road, Bennington, Vermont 05201. 4. Wesley Bennet owns a Redman 2000 mobile home with serial number: 12235896 (the "Mobile Home"), which is located at White Birches Mobile Home Park Lot 21, Barney Road in Bennington, VT 05201. Plaintiff has a security deposit on file in the amount of $510.00 paid by the Defendant. 5. The following creditors, holders of housing subsidy covenants, or others having an interest in the mobile home based on liens or notices of record in the Town of Bennington's Town Offices: None. 6. The mobile home has not been occupied by any person since at least October 8, 2025. It is abandoned. 7. Plaintiff obtained a Writ of Possession for the property, which was served on Tammy Sharby on September 4, 2025. The Writ of Possession was executed on October 8, 2025. 8. Despite the eviction, the mobile home is still located in Lot 21 at the Park. 9. Tax payments are delinquent for years 2011, 2012, 2013, 2014, 2015, 2016, 2017, 2018, 2019, 2020, 2021, 2022, 2023, 2024, 2025, and 2026. Notice of this action has been sent to the Town of Bennington as required by 10 V.S.A 6248(b). 10. In addition to the Mobile Home being abandoned, it appears to be unfit for human habitation. It does not have functioning appliances and plumbing fixtures. It does not appear to have safe and functional electrical fixtures and wiring. It does not contain a safe and functioning heating system. It has openings in its floor and skirt. It is not structurally sound and is not free of trash, debris or pests. 11. Plaintiff obtained a judgment against Defendant in the eviction action, Docket No, 25-CV-00843 in the total amount of $20,856.74, consisting of $15,055.00 in back rent, plus attorney's fees of $5,082.00 and costs of $719.74, with interest accruing at the legal rate. To date, Defendant has made no payment on this judgment. Lot rent continues to accrue until the mobile home is sold or removed from the Park. 12. Mark Garrity, White Birch Mobile Home Park's Owner, will appear at the hearing to testify to the facts supporting these assertions. WHEREFORE, Plaintiff, W.B. Mobile Home Park Inc., respectfully requests that the Mobile Home be declared abandoned and unfit for human habitation and that the Court issue an order conveying the Mobile Home to W.B. ("HFI"), by and through its counsel Nadine L. Scibek, and hereby complains pursuant to 10 V.S.A. 6249(i) as follows: 1. HFI, a Vermont non-profit corporation with a principal place of business in Montpelier, County of Washington, State of Vermont, is the record owner of a mobile home park known as the Mountain View Court Mobile Home Park (the "Park"), located in the Town of Bennington, Vermont. HFI purchased the Park from the Vermont State Housing Authority ("VSHA") on December 31, 2023. The Park is managed by the VSHA. 2. Margaret E. Conklin ("Conklin") is the record owner of a certain mobile home described as a 2006 Titan, 14' x 60', bearing Serial #019-012362A-000H, (the "Mobile Home") located at the Mountain View Court Mobile Home Park, Lot #5, 129 Morgan Street in Bennington, Vermont. There is no Bill of Sale on file according to the Bennington Town Clerk. See attached Bennington Grand List Lookup. There is no Bill of Sale in the Bennington Land Records. 3. Conklin leased a lot in the Park from VSHA pursuant to a written lease. Conklin paid a security deposit in the amount of $250.00 to VSHA. See attached Lease. 4. Conklin's last known mailing address is believed to be 291 Springhill Road, Bennington, VT 05201. 5. The mobile home has been abandoned and is empty/unoccupied. The last known resident of the mobile home was Conklin. All of Conklin's personal property is believed to have been removed from the mobile home and utility services have been terminated. The Park's Counsel has attempted to communicate with Conklin with respect to her intentions with her mobile home with no response. See attached. 6. Conklin was evicted from the Park for nonpayment of rent on or about October 2, 2025 by the Bennington County Sheriff's Department. The mobile home has been vacant since that time. The Court issued a Judgment Order and Writ of Possession to HFI on August 29, 2025. See The Housing Foundation, Inc. v. Conklin, Vermont Superior Court, Bennington Civil Unit, Case No. 25-CV-03517. See attached. 7. The following security interests, mortgages, liens and encumbrances appear of record with respect to the mobile home: a. Conklin is in arrears on obligations to pay property taxes to the Town of Bennington, Vermont in the aggregate amount of $6,762.01, plus interest and penalties. See attached copy of Tax Bill and Delinquent Tax Report. 8. Mobile home storage fees continue to accrue at the rate of $521.00 per month. Rent/ storage fees due HFI through February, 2026 total $5,970.88. Attorney's fees and court costs incurred by HFI currently exceed $2,000.00. 9. HFI sent written notice by certified mail to the Town of Bennington on January 28, 2026 of its intent to commence this action. See attached. 10. The mobile home is uninhabitable. Thomas Young, Property Manager, will testify under oath as to the poor and unlivable condition of this mobile home at the abandonment hearing. WHEREFORE, HFI respectfully requests that the Honorable Court enter an order as follows: 1. Declare that the mobile home has been abandoned; 2. Transfer the mobile home which is unfit for human habitation to the Park owner without a public auction so that it may be removed and disposed of accordingly. 3. Order pursuant to 10 V.S.A. 6249(j) that the mobile home and any security deposit paid be conveyed to the Park Owner in "as is" condition, and free from all liens and other encumbrances of record.
