ILLAGE OF NORTH BENNINGTON, VERMONT www:villagenorthbennongton.org NOTICE OF OPEN BURNING AND WASTE INCINERATION ORDINANCE On July 7, 2026, the Trustees of the Village of North Bennington, Vermont, adopted the Open Burning and Waste Incineration ordinance pursuant to 24 V.S.A. 1972. This notice is published pursuant to 24 V.S.A. 1972 to inform the public of this ordinance and of the citizens' right to petition for a vote to disapprove the ordinance. The purpose of this ordinance is to promote the health, safety and general welfare of the inhabitants of the Village of North Bennington, specifically to limit fire and smoke hazards, to limit open burning to that which is approved by the appropriate authority, and to prohibit solid waste disposal practices that constitute a public nuisance to the public health and welfare and/or the environment. Per ACT 162 (H.935) the Village Fire Department Chief shall be the Village Forest Fire Warden. The Fire Warden or designated Deputy Fire Warden will administer Permits to kindle fire including campfires, natural wood, non-woody vegetation, and some construction or demolition debris. The full text defines what materials are permitted to be burned. No burning may be done without a permit. Except for campfires, burn permits are limited to three per year per property. Open burning or incineration of solid waste is prohibited. The ordinance requires all burning be supervised by an adult at all times and have a source of pressurized water and hose. Permits issued for burn areas of 12 cubic yards may require Fire Marshal inspection. The full text details all regulations. The Ordinance is enforceable by the Fire Warden or any o?icial with law enforcement authority under Vermont law. The full text of the Ordinance may be examined at the Depot o?ice at 2 Depot Street by appointment (518-598-9042 or 802-379-1176), or at the Post O?ice, Library, Village bulletin boards, Caf , Left Bank, or Village website. CITIZENS' RIGHT TO PETITION FOR VOTE Title 24 V.S.A. 1973 grants citizens the right to petition for a vote at a special or annual Town Meeting to disapprove ordinance amendments adopted by the Trustees. To exercise this right, citizens must present to the Trustees or the Town Clerk a petition for a vote on the question of disapproving the amendments signed by not less than five percent (5%) of the Village's qualified voters. The petition must be presented within forty-four (44) days following the date of the adoption of the amendments. Unless a petition requesting a vote is filed pursuant to 24 V.S.A. 1973, the Open Burning and Waste Incineration Ordinance shall become e?ective sixty (60) days from the date of said adoption.
