TOWN OF SANDGATE Sandgate, VT 05250 TITLE: Storage of Animal Feed Document Type: Ordinance Document Number / Revision: Original Issue: Reissue: SECTION I. PURPOSE: The purpose of this ordinance is to reduce the chance of vermin and other wild animals gaining access to improperly stored animal feed, thereby creating a health hazard. SECTION II. RESPONSIBILITY: All owners, lessees, bailees, and caretakers of animals must ensure that food for animals is stored in facilities that adequately protect such supplies against spoilage or deterioration and infestation or contamination by vermin. Food supplies shall be stored in containers with tightly fitting lids or covers or in the original containers as received from the commercial sources of supply. SECTION III. PENALTIES: A. In the event of a violation of this ordinance, there shall be a civil fine of $50.00 for a first offense, and a civil fine $100.00 for each subsequent offense. B. Each instance of unsecured animal food on a given day shall constitute a separate offense. SECTON IV. ENFORCEMENT: This ordinance will be enforced by the Town Health Officer and Town Constable. SECTION V. RIGHT TO A HEARING: The property owner, lessee, bailee, or caretaker of the property shall upon 48 hours notice to the Selectboard be entitled to a hearing before the Board on whether animal food is now adequately secured per this ordinance. SECTION VI. SEVERABILITY: In the event that a Court of competent jurisdiction declares a provision of this ordinance or portion thereof void or unenforceable, the remaining portions and provisions shall remain in full force and effect. The purpose of the maintenance is to improve safety and prolong the life of certain infrastructure. Selective ground applications will be made using backpack sprayers or motor driven diaphragm pumps with handheld applicators.
