MATHESON AND OCCUPANTS RESIDING AT 933 EAST ROAD, BENNINGTON, VT 05201 DEFENDANT(S) NOTICE OF SALE In accordance with the Judgment and Decree of Foreclosure by Judicial Sale filed on May 14, 2025, in the above captioned action brought to foreclose that certain mortgage given by Glenn A. Matheson and Jodi L. Matheson to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Novastar Mortgage, Inc., dated November 25, 2005, and recorded in Book 427, at Page 140, of the Town of Bennington Land Records, of which mortgage the undersigned is the present holder by virtue of the following Assignments of Mortgage: (1) Assignment of Mortgage from Mortgage Electronic Registration Systems, Inc. (MERS) as nominee for Novastar Mortgage, Inc. to The Bank of New York Mellon, as Successor Trustee under NovaStar Mortgage Funding Trust 2005-4 recorded in Book 460, at Page 82 and (2) Corrective Assignment of Mortgage from Mortgage Electronic Registration Systems, Inc. (MERS) as nominee for Novastar Mortgage, Inc. to The Bank of New York Mellon fka The Bank of New York, as successor Trustee for JPMorgan Chase Bank, N.A., as Trustee for Novastar Mortgage Funding Trust, Series 2005-4 Novastar Home Equity Loan Asset-Backed Certificates, Series 2005-4 recorded in Book 488, at Page 56, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction on August 6, 2025 at 02:00 PM at933 East Road, Bennington, VT 05201 all and singular the premises described in said mortgage, To Wit: Being all and the same lands and premises conveyed to Glenn A. Matheson and Jodi L. Matheson by Quit Claim Deed of Glenn Matheson dated November 25, 2005 and recorded December 1, 2005 in Book 427, at Page 139 of the Town of Bennington Land Records and further described therein. Also being all and the same lands and premises conveyed to Glenn Matheson by Warranty Deed of Stella R. Bruneau dated July 21, 2004 and recorded July 22, 2004 in Bok 411, at Page 53 of the Town of Bennington Land Records and further described therein. The description of the property contained in the mortgage shall control in the event of a typographical error in this publication. The public sale may be adjourned one or more times for a total time not exceeding 30 days, without further court order, and without publication or service of a new notice of sale, by announcement of the new sale date to those present at each adjournment or by posting notice of the adjournment in a conspicuous place at the location of the sale. Terms of Sale: $10,000.00 to be paid in cash or by certified check by the purchaser at the time of sale, with the balance due at closing. The sale is subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens, if any, which take precedence over the said mortgage above described.
